TERMS & CONDITIONS
The terms that govern our service to you.
1.0 Introduction
1.1 These Terms and Conditions (“Terms”) govern the relationship between you, the customer (“You”), and us, TradiePages Pty Ltd trading as TradiePages (“We” or “TradiePages”). They apply to all services provided by us to you, or to the general public on your behalf, including but not limited to the creation, publication, and ongoing hosting of your webpage (“TradiePage”). By using our services, you agree to be bound by these Terms.
1.2 All the other information on our website forms part of our Terms & Conditions, in particular the Pricing and FAQ pages.
2.0 Services Provided
2.1 TradiePages’ primary service is the creation, publication, and ongoing hosting of a website designed by us. We may also offer add-ons and upgrades to this product, and other ancillary and complementary products.
2.2 You authorise TradiePages to publish your name, details, photo, and other content, as supplied by you, on your TradiePage.
2.3 You have complete discretion over what information is published on your TradiePage, subject to 2.4 and 2.5.
2.4 We reserve the right to refuse to publish, or to remove, any content we deem to be offensive, discriminatory, or otherwise inappropriate for a general audience.
2.5 We reserve the right to refuse to publish, or to remove, any content that is disallowed under the laws of any relevant jurisdiction.
2.6 Upon being notified of any error or omission in the content of your TradiePage, we will rectify such errors or omissions as soon as practicable, usually within two business days. In line with 9.0, we do not accept any liability for loss or damage resulting from any such errors or omissions, or from any delays in correcting said errors or omissions.
2.7 A fundamental characteristic of our product is that it is highly templated, and this is reflected in the low price point of our offering as compared to a custom-built website. You acknowledge that your TradiePage will share a standard design with other TradiePages, and that we will offer you a fixed set of choices of colour, feature images, icons, and other design elements. Accordingly, it is possible that your TradiePage may look similar to the TradiePages of other tradies, possibly including your competitors.
2.8 In accordance with 2.7, we reserve the right to decline any requests for customisation of any TradiePage or related product or service offering. We may, at our total discretion, offer optional upgrades, additional features, or customisations, for a fee. However, as per 2.8, our products are primarily offered on a set templated basis.
2.9 Although each TradiePage is designed to optimize for SEO, there are various other factors that influence a website’s ranking on search engines such as Google. Accordingly, TradiePages cannot guarantee where your TradiePage will appear in the search engine results page for any given keyword.
2.10 You are solely responsible for determining your eligibility to promote or advertise your business under your chosen name. We do not require you to have a registered business name in order to purchase a TradiePage.
2.11 Further to 2.10, we do not take any responsibility in the case of any dispute between parties seeking a TradiePage under the same name, or for any TradiePage that is alleged to infringe on any trademark, copyright or other branding or intellectual property rights of any other business. This is solely a matter for the respective business owners to resolve, and shall not involve TradiePages in any way.
3.0 Ownership and Rights
3.1 Your TradiePage is our product, and is the core of our business offering. Accordingly, we retain full legal ownership and rights to your TradiePage.
3.2 We transfer and grant to you the legal ownership and rights to the custom logo we create for your business as part of the creation of your TradiePage.
4.0 Stability and Security
4.1 No online service can guarantee 100% uptime. Like any business, we are reliant on our service providers (e.g. web hosting services) for the continuity of our own service. TradiePages has selected reliable providers and implemented redundancies and backups to maximise the security and stability of each TradiePage. We will take all reasonable steps to ensure maximum uptime for your TradiePage.
4.2 Where all reasonable steps have been taken, TradiePages will not be liable for any loss or damage arising from any outage of your TradiePage.
4.3 TradiePages will take all reasonable steps to ensure the security of your business information and personal information.
4.4 Where all reasonable steps have been taken, TradiePages will not be liable for any loss or damage arising from any security breach.
5.0 Fees, Payments, Cancellations, and Refunds
5.1 Our current fees can be found on our Pricing page.
5.2 You will be charged a one-off Build Fee for the creation of your TradiePage. This fee is non-refundable once work has commenced, which is typically within 24 hours of receiving your ‘Wording and Images’ questionnaire.
5.3 You will be charged a monthly subscription fee via direct debit for the ongoing hosting and maintenance of your TradiePage.
5.4 You may cancel your monthly subscription at any time.
5.5 Upon cancellation, no refund will be provided for the unused portion of the month. Instead, your TradiePage will remain live for the remainder of the month you have paid for.
5.6 You may choose to forego the remaining time and close down the TradiePage immediately. This will be actioned within two business days. No refund will arise from this choice.
5.7 In the event that your monthly direct debit fails, for any reason, we will make a minimum of two attempts to contact you in the following seven days. Should your monthly subscription fee remain unpaid beyond this date, we reserve the right to take down your TradiePage.
5.8 Following a cancellation, whether initiated by your or by us, for any reason, we will archive your page and hold your TradiePage URL for 30 days. Beyond this time, we reserve the right to release your URL and delete your page. Should you wish to reinstate your TradiePage after this point, you would need to pay the Build Fee again.
5.9 For clarity, following a cancellation and the 30-day archive period, as per 5.8, any business may take up and utilise your previous URL if they purchase a TradiePage with that business name.
6.0 Refer A Mate
6.1 Details of current Refer A Mate deals can be found on the Refer A Mate page of our website, which forms part of these Terms as per 1.1.
6.2 We reserve the right to change or remove any Refer A Mate deals at any time.
6.3 You can provide us with the contact details of as many mates as you wish, at any time. We will record these referrals for future reference. There is no time limit or expiry period.
6.4 To constitute a valid referral, your mate must not already be on our email list.
6.5 Subject to 6.4, a referral reward (for example, a Build Fee refund, or a 3-month subscription credit) is ‘granted’ when a mate whose contact details you have previously provided pays their Build Fee.
6.6 Refunds, credits or rewards arising from the referral of a mate will be processed within two business days. In the case of monetary refunds, additional bank processing time may also apply.
6.6 In the case of subscription credits, if the granting and processing of your credits falls close to your monthly billing date, we may not be able to credit your immediate upcoming payment. In this circumstance, the credit will be applied to your next monthly subscription payment instead.
7.0 Termination
7.1 TradiePages reserves the right to terminate your access to our services and your TradiePage at any time for any reason, including but not limited to, breach of these Terms and Conditions.
8.0 Intellectual Property Rights
8.1 TradiePages respects the intellectual property rights of others and expects its customers to do the same. You are responsible for ensuring that the content you provide for your TradiePage does not infringe upon any third-party intellectual property rights.
8.2 In the event of any intellectual property infringement claims arising from the content you provided, you agree to indemnify and hold harmless TradiePages from any liability, costs, or damages.
9.0 Limitation of Liability
9.1 To the extent permitted by law, TradiePages shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from the use of or inability to use our services.
9.2 In no event shall TradiePages’ total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing our services.
10.0 Warranty Disclaimer
10.1 TradiePages provides its services “as is” and without warranty of any kind, whether express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 TradiePages does not warrant that the operation of your TradiePage will be uninterrupted or error-free or that defects in the services will be corrected.
11.0 Force Majeure
11.1 TradiePages shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is due to circumstances beyond its reasonable control, including but not limited to, acts of God, war, terrorism, labor disputes, natural disasters, or government actions.
12.0 Indemnification
12.1 You agree to indemnify, defend, and hold harmless TradiePages, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of our services.

14.0 Obligation to Third-Party Users
14.1 TradiePages relies on our customers to provide up-to-date and accurate information. However we do not conduct identity checks of the business owners who purchase a TradiePage, nor do we independently verify the information they choose to publish on their TradiePage.
14.2 Accordingly, we make no representations as to the accuracy of the information published on any TradiePage built or hosted by us, including the identity, quality or reliability of any business that has purchased a TradiePage.
14.3 For clarity, TradiePages shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from the use of or inability to use our services by any third party or member of the public.
15.0 Compliance with Laws
15.1 TradiePages will comply with all relevant consumer laws, privacy laws, and all other applicable regulations.
16.0 Governing Law
16.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
17.0 Changes to the Terms and Conditions
17.1 TradiePages reserves the right to modify these Terms at any time. Any changes will be published on the TradiePages website, and your continued use of our services after such changes will constitute your acceptance of the revised Terms.
